{"id":11044,"date":"2026-04-21T16:37:00","date_gmt":"2026-04-21T14:37:00","guid":{"rendered":"https:\/\/kosovatimes.info\/?p=11044"},"modified":"2026-04-21T18:01:54","modified_gmt":"2026-04-21T16:01:54","slug":"supremja-m-p-dhe-zh-z-te-akuzuar-per-krime-lufte-mbesin-ne-paraburgim","status":"publish","type":"post","link":"https:\/\/kosovatimes.info\/index.php\/2026\/04\/21\/supremja-m-p-dhe-zh-z-te-akuzuar-per-krime-lufte-mbesin-ne-paraburgim\/","title":{"rendered":"Supremja: M.P dhe Zh.Z t\u00eb akuzuar p\u00ebr krime lufte mbesin n\u00eb paraburgim"},"content":{"rendered":"\n<p><strong>Gjykata Supreme e Kosov\u00ebs ka refuzuar si t\u00eb pabazuara k\u00ebrkesat p\u00ebr mbrojtje t\u00eb ligjshm\u00ebris\u00eb t\u00eb paraqitura nga mbrojtja e t\u00eb pandehurve M.P. dhe Zh.Z., t\u00eb akuzuar p\u00ebr krime lufte kund\u00ebr popullat\u00ebs civile.<\/strong><\/p>\n\n\n\n<p>N\u00eb aktgjykim, Kolegji i Gjykat\u00ebs Supreme ka shqyrtuar ankesat ndaj vendimeve t\u00eb Gjykat\u00ebs Themelore n\u00eb Prishtin\u00eb dhe Gjykat\u00ebs s\u00eb Apelit, t\u00eb cilat kishin lidhje me vazhdimin e paraburgimit ndaj t\u00eb pandehurve t\u00eb akuzuar p\u00ebr vepr\u00ebn penale n\u00eb bashk\u00ebkryerje \u201cKrime lufte kund\u00ebr popullat\u00ebs civile\u201d, sipas ligjit penal n\u00eb fuqi n\u00eb koh\u00ebn e kryerjes s\u00eb vepr\u00ebs, aktualisht e inkriminuar si \u201cKrim kund\u00ebr njer\u00ebzimit\u201d sipas Kodit Penal t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs.<\/p>\n\n\n\n<p>Sipas gjykat\u00ebs, ekziston dyshim i bazuar se t\u00eb akuzuarit kan\u00eb kryer vepr\u00ebn penale p\u00ebr t\u00eb cil\u00ebn ngarkohen, duke p\u00ebrmbushur k\u00ebshtu kushtet ligjore p\u00ebr vazhdimin e mas\u00ebs s\u00eb paraburgimit.<\/p>\n\n\n\n<p>Gjykata gjithashtu ka vler\u00ebsuar se ekziston rrezik i arratisjes n\u00ebse t\u00eb pandehurit do t\u00eb mbroheshin n\u00eb liri, duke marr\u00eb parasysh pesh\u00ebn e vepr\u00ebs penale, d\u00ebnimet e mundshme dhe faktin se ata jan\u00eb shtetas t\u00eb Serbis\u00eb dhe posedojn\u00eb dokumente udh\u00ebtimi q\u00eb mund\u00ebsojn\u00eb l\u00ebvizjen jasht\u00eb vendit.<\/p>\n\n\n\n<p>\u201cN\u00eb k\u00ebto rrethana, masa e paraburgimit konsiderohet e nevojshme p\u00ebr sigurimin e prezenc\u00ebs s\u00eb tyre dhe zhvillimin e rregullt t\u00eb procedur\u00ebs penale\u201d, konsideron gjykata.<\/p>\n\n\n\n<p>N\u00eb vendim theksohet se gjykatat m\u00eb t\u00eb ul\u00ebta kan\u00eb dh\u00ebn\u00eb arsye t\u00eb mjaftueshme ligjore dhe nuk jan\u00eb konstatuar shkelje esenciale t\u00eb procedur\u00ebs penale, nd\u00ebrsa masat alternative ndaj paraburgimit jan\u00eb vler\u00ebsuar si t\u00eb pamjaftueshme n\u00eb k\u00ebt\u00eb rast.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gjykata Supreme e Kosov\u00ebs ka refuzuar si t\u00eb pabazuara k\u00ebrkesat p\u00ebr mbrojtje t\u00eb ligjshm\u00ebris\u00eb t\u00eb paraqitura nga mbrojtja e t\u00eb pandehurve M.P. dhe Zh.Z., t\u00eb akuzuar p\u00ebr krime lufte kund\u00ebr popullat\u00ebs civile.
