{"id":12198,"date":"2026-04-28T08:34:00","date_gmt":"2026-04-28T06:34:00","guid":{"rendered":"https:\/\/kosovatimes.info\/?p=12198"},"modified":"2026-04-28T18:01:20","modified_gmt":"2026-04-28T16:01:20","slug":"ikd-procesi-per-zgjedhjen-e-presidentit-cenon-rendin-kushtetues","status":"publish","type":"post","link":"https:\/\/kosovatimes.info\/index.php\/2026\/04\/28\/ikd-procesi-per-zgjedhjen-e-presidentit-cenon-rendin-kushtetues\/","title":{"rendered":"IKD: Procesi p\u00ebr zgjedhjen e Presidentit cenon rendin kushtetues"},"content":{"rendered":"\n<p><strong>Instituti i Kosov\u00ebs p\u00ebr Drejt\u00ebsi (IKD) ka vler\u00ebsuar se procesi aktual p\u00ebr zgjedhjen e Presidentit t\u00eb Kosov\u00ebs po shoq\u00ebrohet me shkelje serioze t\u00eb rendit kushtetues dhe t\u00eb rregullave parlamentare, duke ngritur shqet\u00ebsime p\u00ebr funksionimin e demokracis\u00eb dhe sundimin e ligjit n\u00eb vend.<\/strong><\/p>\n\n\n\n<p>Sipas IKD-s\u00eb, mungesa e kuorumit n\u00eb seanc\u00ebn e jasht\u00ebzakonshme e b\u00ebn t\u00eb pavlefsh\u00ebm vet\u00eb zhvillimin e procedur\u00ebs. Kushtetuta e Kosov\u00ebs k\u00ebrkon pranin\u00eb e s\u00eb paku 80 deputet\u00ebve p\u00ebr nisjen e seanc\u00ebs dhe zhvillimin e dy raundeve t\u00eb para t\u00eb votimit, nd\u00ebrsa n\u00eb rastin konkret kan\u00eb qen\u00eb t\u00eb pranish\u00ebm vet\u00ebm 64 deputet\u00eb. N\u00eb k\u00ebto rrethana, \u00e7do veprim procedural konsiderohet shkelje e r\u00ebnd\u00eb dhe krijon precedent t\u00eb rreziksh\u00ebm p\u00ebr anashkalimin e normave kushtetuese.<\/p>\n\n\n\n<p>IKD ka kritikuar edhe m\u00ebnyr\u00ebn e thirrjes s\u00eb mbledhjes s\u00eb Komisionit p\u00ebr Legjislacion, e cila \u00ebsht\u00eb b\u00ebr\u00eb vet\u00ebm dy minuta para mbajtjes s\u00eb saj. Nj\u00eb praktik\u00eb e till\u00eb, sipas tyre, cenon standardet minimale t\u00eb transparenc\u00ebs dhe pengon pjes\u00ebmarrjen efektive t\u00eb deputet\u00ebve, duke e reduktuar procesin n\u00eb nj\u00eb formalitet pa legjitimitet t\u00eb plot\u00eb.<\/p>\n\n\n\n<p>N\u00eb reagim theksohet gjithashtu se \u00e7\u00ebshtja e nominimeve dhe e n\u00ebnshkrimeve t\u00eb deputet\u00ebve \u00ebsht\u00eb trajtuar n\u00eb kund\u00ebrshtim me kuadrin kushtetues dhe praktik\u00ebn gjyq\u00ebsore. Edhe pse m\u00eb 5 mars 2026 jan\u00eb propozuar dy kandidat\u00eb p\u00ebr President, t\u00ebrheqja e tyre nga gara nuk i rikthen n\u00ebnshkrimet n\u00eb dispozicion p\u00ebr kandidat\u00eb t\u00eb tjer\u00eb. Sipas IKD-s\u00eb, n\u00ebnshkrimet konsiderohen t\u00eb konsumuara n\u00eb momentin e dor\u00ebzimit dhe jan\u00eb t\u00eb lidhura ekskluzivisht me kandidatin p\u00ebrkat\u00ebs.<\/p>\n\n\n\n<p>Ky q\u00ebndrim mb\u00ebshtetet edhe n\u00eb praktik\u00ebn e Gjykat\u00ebs Kushtetuese, konkretisht n\u00eb rastin KI 47\/10, ku theksohet se n\u00ebnshkrimet nuk mund t\u00eb t\u00ebrhiqen n\u00eb m\u00ebnyr\u00eb arbitrare pasi t\u00eb jen\u00eb dor\u00ebzuar.
