{"id":14629,"date":"2026-05-11T12:18:00","date_gmt":"2026-05-11T10:18:00","guid":{"rendered":"https:\/\/kosovatimes.info\/?p=14629"},"modified":"2026-05-11T15:14:33","modified_gmt":"2026-05-11T13:14:33","slug":"specialja-interpretimet-e-raportit-britanik-jane-te-pasakta","status":"publish","type":"post","link":"https:\/\/kosovatimes.info\/index.php\/2026\/05\/11\/specialja-interpretimet-e-raportit-britanik-jane-te-pasakta\/","title":{"rendered":"Specialja: Interpretimet e raportit britanik jan\u00eb t\u00eb pasakta"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Dhomat e Specializuara t\u00eb Kosov\u00ebs kan\u00eb reaguar ndaj interpretimeve t\u00eb b\u00ebra p\u00ebr raportin e Komitetit t\u00eb t\u00eb Drejtave t\u00eb Njeriut t\u00eb Dhom\u00ebs s\u00eb Avokat\u00ebve t\u00eb Anglis\u00eb dhe Uellsit, duke i cil\u00ebsuar ato si t\u00eb pasakta dhe n\u00eb kund\u00ebrshtim me p\u00ebrmbajtjen reale t\u00eb dokumentit.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb nj\u00eb reagim&nbsp;Specialja ka theksuar se raporti n\u00eb asnj\u00eb pjes\u00eb t\u00eb tij nuk konstaton se gjyqtar\u00ebt e Dhomave t\u00eb Specializuara kan\u00eb shkelur t\u00eb drejtat e njeriut t\u00eb t\u00eb akuzuarve, si\u00e7 jan\u00eb interpretuar disa prej gjetjeve nga institucione dhe zyrtar\u00eb n\u00eb Kosov\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sipas reagimit, raporti nuk arrin n\u00eb p\u00ebrfundimin se jurisprudenca e Speciales bie ndesh me standardet e Gjykata Evropiane p\u00ebr t\u00eb Drejtat e Njeriut, e po ashtu nuk evidenton shkelje t\u00eb konventave nd\u00ebrkomb\u00ebtare n\u00eb vendimet q\u00eb lidhen me paraburgimin e t\u00eb akuzuarve.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb reagim, Dhomat e Specializuara theksojn\u00eb se jan\u00eb institucion gjyq\u00ebsor i pavarur dhe se as Avokati i Popullit i Kosov\u00ebs, e as Komiteti britanik nuk kan\u00eb t\u00eb drejt\u00eb t\u00eb paraqesin parashtrime n\u00eb procedurat gjyq\u00ebsore t\u00eb Speciales.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Specialja vler\u00ebson se disa interpretime t\u00eb raportit, t\u00eb b\u00ebra publikisht nga Avokati i Popullit, \u201cnuk pasqyrojn\u00eb sakt\u00eb p\u00ebrmbajtjen dhe p\u00ebrfundimet e raportit\u201d dhe si t\u00eb tilla, sipas tyre, krijojn\u00eb nj\u00eb perceptim t\u00eb gabuar p\u00ebr funksionimin e gjykat\u00ebs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sipas reagimit, nj\u00eb pjes\u00eb e \u00e7\u00ebshtjeve t\u00eb ngritura n\u00eb raport jan\u00eb argumente q\u00eb tashm\u00eb jan\u00eb paraqitur nga ekipet mbrojt\u00ebse t\u00eb t\u00eb akuzuarve para gjyqtar\u00ebve t\u00eb Speciales, nd\u00ebrsa raporti \u2013 sipas DHSK-s\u00eb \u2013 nuk i pasqyron n\u00eb m\u00ebnyr\u00eb t\u00eb barabart\u00eb kund\u00ebrargumentet e Prokuroris\u00eb dhe t\u00eb p\u00ebrfaq\u00ebsuesve t\u00eb viktimave.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cRaporti pranon se t\u00eb akuzuarit kan\u00eb n\u00eb dispozicion mjete juridike dhe se disa nga \u00e7\u00ebshtjet e ngritura jan\u00eb ende objekt i procedurave gjyq\u00ebsore dhe mund t\u00eb rishikohen n\u00eb apel\u201d, thuhet n\u00eb reagim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ky reagim vjen pas prezantimit t\u00eb raportit preliminar nga Naim Qelaj, i cili jav\u00ebn e kaluar kishte deklaruar se dokumenti i hartuar nga Komiteti britanik identifikonte shqet\u00ebsime serioze p\u00ebr funksionimin e Speciales, p\u00ebrfshir\u00eb edhe pretendime p\u00ebr devijim t\u00eb mandatit nga q\u00ebllimi fillestar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Raporti ishte p\u00ebrgatitur nga Bar Human Rights Committee of England and Wales, me k\u00ebrkes\u00eb t\u00eb Institucionit t\u00eb Avokatit t\u00eb Popullit t\u00eb Kosov\u00ebs, pas shqet\u00ebsimeve t\u00eb ngritura lidhur me respektimin e standardeve t\u00eb t\u00eb drejtave t\u00eb njeriut n\u00eb proceset gjyq\u00ebsore q\u00eb po zhvillohen n\u00eb Hag\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb Dhomat e Specializuara po zhvillohen procese ndaj ish-krer\u00ebve t\u00eb Ushtria \u00c7lirimtare e Kosov\u00ebs, p\u00ebrfshir\u00eb Hashim Tha\u00e7i, Kadri Veseli, Jakup Krasniqi dhe Rexhep Selimi, t\u00eb cil\u00ebt po p\u00ebrballen me akuza p\u00ebr krime lufte dhe pengim t\u00eb drejt\u00ebsis\u00eb.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Dhomat e Specializuara t\u00eb Kosov\u00ebs kan\u00eb reaguar ndaj interpretimeve t\u00eb b\u00ebra p\u00ebr raportin e Komitetit t\u00eb t\u00eb Drejtave t\u00eb Njeriut t\u00eb Dhom\u00ebs s\u00eb Avokat\u00ebve t\u00eb Anglis\u00eb dhe Uellsit, duke i cil\u00ebsuar ato si t\u00eb pasakta dhe n\u00eb kund\u00ebrshtim me p\u00ebrmbajtjen reale t\u00eb dokumentit.
