{"id":15014,"date":"2026-05-13T15:02:00","date_gmt":"2026-05-13T13:02:00","guid":{"rendered":"https:\/\/kosovatimes.info\/?p=15014"},"modified":"2026-05-13T17:17:11","modified_gmt":"2026-05-13T15:17:11","slug":"supremja-shfuqizon-pjeserisht-rregulloren-e-up-se-per-avancimin-akademik","status":"publish","type":"post","link":"https:\/\/kosovatimes.info\/index.php\/2026\/05\/13\/supremja-shfuqizon-pjeserisht-rregulloren-e-up-se-per-avancimin-akademik\/","title":{"rendered":"Supremja shfuqizon pjes\u00ebrisht Rregulloren e UP-s\u00eb p\u00ebr avancimin akademik"},"content":{"rendered":"\n<p><strong>Gjykata Supreme e Kosov\u00ebs ka aprovuar pjes\u00ebrisht k\u00ebrkes\u00ebpadin\u00eb e paraqitur nga Instituti i Kosov\u00ebs p\u00ebr Drejt\u00ebsi (IKD) kund\u00ebr Universiteti i Prishtin\u00ebs Hasan Prishtina, n\u00eb lidhje me ligjshm\u00ebrin\u00eb e disa dispozitave t\u00eb Rregullores p\u00ebr Procedurat P\u00ebrzgjedh\u00ebse p\u00ebr Em\u00ebrimin, Avancimin dhe Rizgjedhjen e Personelit Akademik.<\/strong><\/p>\n\n\n\n<p>Sipas njoftimit, n\u00eb aktgjykimin e saj, Gjykata Supreme ka shpallur t\u00eb paligjsh\u00ebm dhe ka shfuqizuar nenin 18, paragrafi 7 t\u00eb rregullores s\u00eb kontestuar, i cili i jepte t\u00eb drejt\u00eb Senatit t\u00eb Universitetit t\u00eb Prishtin\u00ebs q\u00eb \u201cn\u00eb \u00e7do moment t\u00eb t\u00ebrheq\u00eb njohjen e publikimit n\u00eb revistat ose botuesit e dyshimt\u00eb, por para vler\u00ebsimit p\u00ebrfundimtar t\u00eb kandidatit\u201d.<\/p>\n\n\n\n<p>Gjykata ka vler\u00ebsuar se kjo dispozit\u00eb nuk mb\u00ebshtetet n\u00eb autorizim t\u00eb mjaftuesh\u00ebm ligjor apo statutar, tejkalon kompetencat e p\u00ebrcaktuara me Ligjin p\u00ebr Arsimin e Lart\u00eb dhe Statutin e Universitetit t\u00eb Prishtin\u00ebs, si dhe cenon parimet e siguris\u00eb juridike, parashikueshm\u00ebris\u00eb dhe pritshm\u00ebrive legjitime t\u00eb kandidat\u00ebve n\u00eb procedurat e avancimit akademik.<\/p>\n\n\n\n<p>\u201cN\u00eb arsyetim, Gjykata Supreme thekson se termat \u201crevista t\u00eb dyshimta\u201d dhe \u201cbotues t\u00eb dyshimt\u00eb\u201d nuk jan\u00eb t\u00eb p\u00ebrcaktuara qart\u00eb n\u00eb legjislacionin n\u00eb fuqi, nd\u00ebrsa dispozita nuk p\u00ebrmban kritere objektive, procedura t\u00eb qarta vendimmarrjeje apo mjete juridike mbrojt\u00ebse p\u00ebr kandidat\u00ebt, duke krijuar hap\u00ebsir\u00eb p\u00ebr arbitraritet administrative\u201d, thuhet n\u00eb njoftim.<\/p>\n\n\n\n<p>Gjykata po ashtu vler\u00ebsoi se vler\u00ebsimi i publikimeve shkencore duhet t\u00eb bazohet n\u00eb statusin e revist\u00ebs n\u00eb momentin e publikimit t\u00eb punimit, nd\u00ebrsa ndryshimet e m\u00ebvonshme n\u00eb status nuk mund t\u00eb prodhojn\u00eb pasoja retroaktive p\u00ebr kandidat\u00ebt, p\u00ebrve\u00e7 n\u00ebse provohet shkelje nga vet\u00eb autori.<\/p>\n\n\n\n<p>Tutje thuhet se sa i p\u00ebrket pjes\u00ebs tjet\u00ebr t\u00eb k\u00ebrkes\u00ebpadis\u00eb, Gjykata Supreme e ka refuzuar si t\u00eb pabazuar k\u00ebrkes\u00ebn p\u00ebr shpalljen e paligjshme dhe shfuqizimin e fusnot\u00ebs 16 t\u00eb s\u00eb nj\u00ebjt\u00ebs rregullore.
