Nd\u00ebrkaq, Prokuroria e Apelit ka propozuar q\u00eb p\u00ebrgjigjet ndaj ankes\u00ebs t\u00eb paraqitura nga Alaj dhe Xharra t\u00eb refuzohen, nd\u00ebrsa ankesa e PSRK-s\u00eb t\u00eb aprovohet si e bazuar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb vendimin e Apelit thuhet se nuk q\u00ebndrojn\u00eb pretendimet e PSRK-s\u00eb p\u00ebr shkelje t\u00eb Ligjit Penal, pasi q\u00eb as vet\u00eb Prokuroria nuk ka specifikuar ndonj\u00eb dispozit\u00eb t\u00eb Kodit t\u00eb Procedur\u00ebs Penale q\u00eb \u00ebsht\u00eb shkelur nga gjykata e shkall\u00ebs s\u00eb par\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">M\u00eb tej, sipas vendimit, nuk q\u00ebndrojn\u00eb as pretendimet e PSRK-s\u00eb p\u00ebr v\u00ebrtetim t\u00eb gabuar dhe jo t\u00eb plot\u00eb t\u00eb gjendjes faktike, pasi nga ankesa v\u00ebrehet se m\u00eb shum\u00eb b\u00ebhet fjal\u00eb p\u00ebr mospajtim t\u00eb Prokuroris\u00eb me konkluzionet e nxjerra nga gjykata e shkall\u00ebs s\u00eb par\u00eb, e cila kishte konstatuar se nuk \u00ebsht\u00eb v\u00ebrtetuar se t\u00eb akuzuarit kan\u00eb kryer vepr\u00ebn penale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sipas vendimit, bashkimi i strukturuar n\u00eb vepr\u00ebn penale t\u00eb krimit t\u00eb organizuar k\u00ebrkon q\u00eb an\u00ebtar\u00ebt t\u00eb mos jen\u00eb t\u00eb p\u00ebrfshir\u00eb rast\u00ebsisht n\u00eb veprimtari t\u00eb tilla, por nuk k\u00ebrkon rol formal n\u00eb struktur\u00eb, vazhdim\u00ebsi t\u00eb an\u00ebtar\u00ebsis\u00eb apo nj\u00eb struktur\u00eb t\u00eb nd\u00ebrtuar n\u00eb m\u00ebnyr\u00eb t\u00eb ve\u00e7ant\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Po ashtu, sipas Apelit, n\u00eb v\u00ebshtrim t\u00eb k\u00ebtyre elementeve p\u00ebr t\u00eb cilat ngarkoheshin t\u00eb akuzuarit, rezulton se gjykata e shkall\u00ebs s\u00eb par\u00eb ka konstatuar se nuk \u00ebsht\u00eb provuar se ata kan\u00eb kryer vepr\u00ebn penale p\u00ebr t\u00eb cil\u00ebn akuzoheshin, bazuar n\u00eb provat e administruara gjat\u00eb shqyrtimit gjyq\u00ebsor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gjithashtu, sipas vendimit t\u00eb Apelit, n\u00eb k\u00ebt\u00eb \u00e7\u00ebshtje penale nuk \u00ebsht\u00eb v\u00ebrtetuar fakti se t\u00eb akuzuarit kan\u00eb shitur apo falsifikuar viza Shengen p\u00ebr persona t\u00eb caktuar. Po ashtu, nuk \u00ebsht\u00eb provuar se ata jan\u00eb organizuar, drejtuar, themeluar, mbik\u00ebqyrur apo koordinuar nga Uk\u00eb Rugova dhe Izet Beqiri si grup kriminal me q\u00ebllim p\u00ebrfitimi t\u00eb kund\u00ebrligjsh\u00ebm.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb vendim thuhet gjithashtu se nga d\u00ebshmit\u00eb e t\u00eb gjith\u00eb d\u00ebshmitar\u00ebve \u00ebsht\u00eb v\u00ebrtetuar fakti se vizat ishin t\u00eb v\u00ebrteta dhe valide, t\u00eb vendosura n\u00eb dokumente t\u00eb rregullta udh\u00ebtimi \u2013 pasaporta t\u00eb vlefshme.
