{"id":19278,"date":"2026-06-09T15:46:00","date_gmt":"2026-06-09T13:46:00","guid":{"rendered":"https:\/\/kosovatimes.info\/?p=19278"},"modified":"2026-06-09T16:05:24","modified_gmt":"2026-06-09T14:05:24","slug":"vendimi-per-qendren-rezidenciale-ne-gracanice-eshte-kushtetues","status":"publish","type":"post","link":"https:\/\/kosovatimes.info\/index.php\/2026\/06\/09\/vendimi-per-qendren-rezidenciale-ne-gracanice-eshte-kushtetues\/","title":{"rendered":"Vendimi p\u00ebr Qendr\u00ebn Rezidenciale n\u00eb Gra\u00e7anic\u00eb \u00ebsht\u00eb kushtetues"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Gjykata Kushtetuese e Republik\u00ebs s\u00eb Kosov\u00ebs ka vendosur n\u00eb rastin KO84\/25, t\u00eb iniciuar nga Komuna e Gra\u00e7anic\u00ebs, duke konstatuar se Vendimi i Qeveris\u00eb s\u00eb Kosov\u00ebs p\u00ebr nd\u00ebrtimin e \u201cQendr\u00ebs Rezidenciale t\u00eb Kosov\u00ebs p\u00ebr autiz\u00ebm, sindrom\u00eb daun dhe aft\u00ebsi t\u00eb kufizuara\u201d \u00ebsht\u00eb n\u00eb p\u00ebrputhje me Kushtetut\u00ebn.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gjykata e ka shpallur k\u00ebrkes\u00ebn e Komun\u00ebs s\u00eb Gra\u00e7anic\u00ebs t\u00eb pranueshme, por me gjasht\u00eb vota p\u00ebr dhe nj\u00eb kund\u00ebr ka vendosur q\u00eb Vendimi [nr. 05\/218], i miratuar m\u00eb 28 gusht 2024, nuk cenon nenet kushtetuese q\u00eb rregullojn\u00eb pushtetin lokal dhe autonomin\u00eb komunale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Po ashtu, Gjykata ka shfuqizuar mas\u00ebn e p\u00ebrkohshme t\u00eb vendosur m\u00eb 31 korrik 2025, si dhe vendimet p\u00ebr vazhdimin e saj m\u00eb 21 tetor 2025 dhe 28 janar 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u00ebnda kishte t\u00eb b\u00ebnte me vendimin e Qeveris\u00eb p\u00ebr nd\u00ebrtimin e nj\u00eb kompleksi rezidencial social n\u00eb disa parcela n\u00eb Gra\u00e7anic\u00eb, t\u00eb cilat do t\u00eb kalonin n\u00eb pron\u00ebsi t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs dhe do t\u2019i jepeshin n\u00eb shfryt\u00ebzim Shoqat\u00ebs Bamir\u00ebse \u201cJetimat e Ballkanit\u201d p\u00ebr nj\u00eb periudh\u00eb 99-vje\u00e7are.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Komuna e Gra\u00e7anic\u00ebs kishte pretenduar se vendimi ishte marr\u00eb pa konsultim dhe se cenonte kompetencat komunale, si dhe pron\u00ebn publike dhe interesat lokale. Po ashtu, ishte argumentuar se projekti mund t\u00eb kishte ndikim n\u00eb mjedis dhe se disa procese paraprake komunale nuk ishin respektuar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Megjithat\u00eb, Gjykata Kushtetuese vler\u00ebsoi se nd\u00ebrtimi i qendr\u00ebs p\u00ebrb\u00ebn interes publik t\u00eb qart\u00eb dhe t\u00eb pakontestuesh\u00ebm, dhe se kompetencat e pushtetit lokal nuk jan\u00eb absolute, por ushtrohen n\u00eb harmoni me Kushtetut\u00ebn dhe ligjet n\u00eb fuqi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sipas Gjykat\u00ebs, Ligji p\u00ebr Pron\u00ebn Publike dhe korniza kushtetuese i japin p\u00ebrpar\u00ebsi interesit publik n\u00eb raste t\u00eb tilla, ve\u00e7an\u00ebrisht kur projekti lidhet me sh\u00ebrbime p\u00ebr kategori t\u00eb ndjeshme t\u00eb shoq\u00ebris\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gjykata theksoi gjithashtu se asnj\u00ebra pal\u00eb nuk e kishte kontestuar ekzistimin e interesit publik p\u00ebr nd\u00ebrtimin e qendr\u00ebs, nd\u00ebrsa projektet alternative t\u00eb komun\u00ebs nuk ishin realizuar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb p\u00ebrfundim, Gjykata konstatoi se vendimi i Qeveris\u00eb nuk cenon autonomin\u00eb lokale dhe \u00ebsht\u00eb n\u00eb p\u00ebrputhje me nenet kushtetuese q\u00eb rregullojn\u00eb pushtetin lokal n\u00eb Republik\u00ebn e Kosov\u00ebs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gjykata Kushtetuese e Republik\u00ebs s\u00eb Kosov\u00ebs ka vendosur n\u00eb rastin KO84\/25, t\u00eb iniciuar nga Komuna e Gra\u00e7anic\u00ebs, duke konstatuar se Vendimi i Qeveris\u00eb s\u00eb Kosov\u00ebs p\u00ebr nd\u00ebrtimin e \u201cQendr\u00ebs Rezidenciale t\u00eb Kosov\u00ebs p\u00ebr autiz\u00ebm, sindrom\u00eb daun dhe aft\u00ebsi t\u00eb kufizuara\u201d \u00ebsht\u00eb n\u00eb p\u00ebrputhje me Kushtetut\u00ebn.
