Po ashtu, Gjykata Supreme njofton se&nbsp; pezullohet procedura e gradimit sipas Konkursit p\u00ebr Gradim t\u00eb dat\u00ebs 28 maj 2026, e shpallur mbi baz\u00ebn e dispozitave t\u00eb kontestuara, deri n\u00eb nxjerrjen e vendimit p\u00ebrfundimtar nga Gjykata Supreme lidhur me k\u00ebt\u00eb \u00e7\u00ebshtje juridike administrative.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Padit\u00ebsja V.Z., nga Vitia, m\u00eb 10 qershor 2026, ka paraqitur n\u00eb Gjykat\u00ebn Supreme padi p\u00ebr shpalljen e paligjshm\u00ebris\u00eb dhe shfuqizimin e pjessh\u00ebm t\u00eb aktit n\u00ebnligjor normativ, p\u00ebrkat\u00ebsisht t\u00eb nenit 7 paragraf\u00ebt 2, 3, 4 dhe 5 t\u00eb Udh\u00ebzimit Administrativ nr. 01\/2026 p\u00ebr Procedur\u00ebn e Gradimit t\u00eb Zyrtar\u00ebve Policor, duke k\u00ebrkuar nj\u00ebkoh\u00ebsisht caktimin e mas\u00ebs s\u00eb posa\u00e7me\/t\u00eb p\u00ebrkohshme t\u00eb sigurimit.&nbsp;Padit\u00ebsja ka pretenduar se dispozitat e kontestuara cenojn\u00eb parimin e meritokracis\u00eb dhe trajtimit t\u00eb barabart\u00eb n\u00eb procesin e gradimit, pasi mund\u00ebsojn\u00eb q\u00eb zyrtar\u00ebt policor\u00eb me s\u00eb paku dhjet\u00eb (10) vite p\u00ebrvoj\u00eb aktive n\u00eb Policin\u00eb e Kosov\u00ebs, t\u00eb cil\u00ebt nuk kan\u00eb p\u00ebrfituar gradim gjat\u00eb k\u00ebsaj periudhe, t\u2019i n\u00ebnshtrohen nj\u00eb procedure t\u00eb ve\u00e7ant\u00eb gradimi dhe t\u00eb aplikojn\u00eb p\u00ebr fitimin e dy gradave m\u00eb t\u00eb larta nj\u00ebherazi, pa iu n\u00ebnshtruar kufizimeve q\u00eb lidhen me koh\u00ebzgjatjen minimale t\u00eb q\u00ebndrimit n\u00eb grad\u00ebn paraprake. Sipas saj, nj\u00eb rregullim i till\u00eb krijon avantazh p\u00ebr nj\u00eb kategori t\u00eb caktuar zyrtar\u00ebsh policor\u00eb n\u00eb raport me ata q\u00eb kan\u00eb kaluar n\u00ebp\u00ebr procedurat e rregullta t\u00eb gradimit dhe kan\u00eb ushtruar detyrat, p\u00ebrgjegj\u00ebsit\u00eb dhe p\u00ebrvoj\u00ebn profesionale t\u00eb lidhura me gradat p\u00ebrkat\u00ebse.&nbsp;Po ashtu, padit\u00ebsja ka pretenduar se dispozitat e kontestuara mund t\u00eb cenojn\u00eb struktur\u00ebn hierarkike dhe zinxhirin komandues brenda Policis\u00eb s\u00eb Kosov\u00ebs, pasi u mund\u00ebsojn\u00eb zyrtar\u00ebve policor\u00eb q\u00eb nuk kan\u00eb ushtruar funksione mbik\u00ebqyr\u00ebse dhe udh\u00ebheq\u00ebse n\u00eb grad\u00ebn e Rreshterit t\u00eb konkurrojn\u00eb drejtp\u00ebrdrejt p\u00ebr grad\u00ebn toger, n\u00eb t\u00eb nj\u00ebjt\u00ebn procedur\u00eb me zyrtar\u00ebt q\u00eb kan\u00eb kaluar proceset paraprake t\u00eb gradimit dhe kan\u00eb fituar p\u00ebrvoj\u00ebn p\u00ebrkat\u00ebse n\u00eb pozita mbik\u00ebqyr\u00ebse. Sipas pretendimeve t\u00eb padit\u00ebses, kjo mund t\u00eb ndikoj\u00eb n\u00eb funksionimin e sistemit t\u00eb gradimit, disiplin\u00ebs organizative dhe menaxhimit t\u00eb personelit policor&#8221;,&nbsp;thuhet n\u00eb komunikat\u00ebn e&nbsp;Gjykat\u00eb Supreme.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pas shqyrtimit t\u00eb k\u00ebrkes\u00ebs, pretendimeve t\u00eb pal\u00ebs padit\u00ebse, provave t\u00eb paraqitura dhe dispozitave ligjore t\u00eb zbatueshme, Gjykata Supreme vler\u00ebsoi se jan\u00eb p\u00ebrmbushur kushtet ligjore t\u00eb parapara me nenin 100 t\u00eb Ligjit nr. 08\/L-182 p\u00ebr Konfliktet Administrative p\u00ebr caktimin e mas\u00ebs s\u00eb posa\u00e7me t\u00eb sigurimit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gjykata konstatoi se padit\u00ebsja ka ngritur pretendime serioze lidhur me ligjshm\u00ebrin\u00eb e dispozitave t\u00eb kontestuara, duke p\u00ebrfshir\u00eb pretendimet p\u00ebr tejkalim t\u00eb autorizimit ligjor, cenim t\u00eb parimit t\u00eb meritokracis\u00eb, ndikim n\u00eb hierarkin\u00eb dhe zinxhirin komandues, si dhe munges\u00eb proporcionaliteti dhe arsyetimi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb vler\u00ebsimin paraprak t\u00eb k\u00ebrkes\u00ebs, Gjykata arriti n\u00eb p\u00ebrfundimin se ekziston rreziku real i shkaktimit t\u00eb nj\u00eb d\u00ebmi t\u00eb r\u00ebnd\u00eb dhe t\u00eb pakthyesh\u00ebm n\u00eb rast t\u00eb vazhdimit t\u00eb zbatimit t\u00eb dispozitave t\u00eb kontestuara dhe procedurave t\u00eb gradimit t\u00eb bazuara n\u00eb to.
