Kushtetuesja vendosi nj\u00ebz\u00ebri se kishte pasur shkelje t\u00eb nenit 31 t\u00eb Kushtetut\u00ebs, q\u00eb garanton t\u00eb drejt\u00ebn p\u00ebr gjykim t\u00eb drejt\u00eb dhe t\u00eb paansh\u00ebm, si dhe t\u00eb nenit 110 q\u00eb garanton pavar\u00ebsin\u00eb e KPK-s\u00eb. P\u00ebr pasoj\u00eb, ajo e anuloi vendimin e Supremes dhe e ktheu \u00e7\u00ebshtjen p\u00ebr rishqyrtim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kontesti lidhej me pozit\u00ebn e Koordinatorit Komb\u00ebtar p\u00ebr Luftimin e Krimit Ekonomik, funksion q\u00eb prej vitit 2013 mbahej nga prokurori Shqipdon Fazliu. N\u00eb prill t\u00eb vitit 2025, KPK kishte ndryshuar rregulloren ekzistuese, duke p\u00ebrcaktuar q\u00eb mandati i Koordinatorit Komb\u00ebtar t\u00eb jet\u00eb trevje\u00e7ar me mund\u00ebsi rizgjedhjeje edhe p\u00ebr nj\u00eb mandat tjet\u00ebr.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pas hyrjes n\u00eb fuqi t\u00eb rregullores s\u00eb re, Fazliu e kishte paditur KPK-n\u00eb n\u00eb Gjykat\u00ebn Supreme, duke pretenduar se ndryshimet kishin efekt retroaktiv dhe cenonin pozit\u00ebn e tij. Supremja e kishte pranuar padin\u00eb, duke vler\u00ebsuar se KPK nuk mund t\u00eb ndryshonte n\u00eb m\u00ebnyr\u00eb t\u00eb nj\u00ebanshme statusin e Koordinatorit pa koordinim me institucionet n\u00ebnshkruese t\u00eb Memorandumit t\u00eb Bashk\u00ebpunimit dhe se kufizimi i mandatit ishte b\u00ebr\u00eb pa baz\u00eb t\u00eb mjaftueshme ligjore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Megjithat\u00eb, Gjykata Kushtetuese arriti n\u00eb p\u00ebrfundim t\u00eb kund\u00ebrt. Sipas saj, Kushtetuta dhe Ligji p\u00ebr KPK-n\u00eb nuk e obligojn\u00eb k\u00ebt\u00eb institucion q\u00eb p\u00ebr \u00e7\u00ebshtjet e organizimit t\u00eb brendsh\u00ebm t\u00eb konsultohet me pal\u00eb t\u00eb tjera, p\u00ebrfshir\u00eb edhe p\u00ebr caktimin e prokuror\u00ebve n\u00eb pozita t\u00eb ve\u00e7anta. Gjykata theksoi se KPK g\u00ebzon pavar\u00ebsi institucionale n\u00eb organizimin e brendsh\u00ebm, p\u00ebrderisa vepron n\u00eb p\u00ebrputhje me Kushtetut\u00ebn dhe ligjet n\u00eb fuqi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kushtetuesja po ashtu vler\u00ebsoi se rasti nuk mund t\u00eb krahasohet me vendimet e m\u00ebparshme q\u00eb kishin t\u00eb b\u00ebnin me kufizimin e mandateve t\u00eb an\u00ebtar\u00ebve t\u00eb KPK-s\u00eb, pasi pozita e Koordinatorit Komb\u00ebtar nuk kishte mandat t\u00eb p\u00ebrcaktuar qart\u00eb me ligj apo me rregulloren e vitit 2013.
