r\u00ebnd\u00eb\u201d dhe \u201cMosdh\u00ebnia e ndihm\u00ebs\u201d.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sipas njoftimit t\u00eb Gjykat\u00ebs, gjyqtarja e procedur\u00ebs paraprake ka caktuar paraburgim ndaj t\u00eb pandehurit B.H., p\u00ebr shkak t\u00eb dyshimit t\u00eb bazuar se ka kryer vepr\u00ebn penale \u201cVrasja e r\u00ebnd\u00eb\u201d nga neni 173, paragrafi 1, n\u00ebnparagrafi 1.4 i Kodit Penal, nd\u00ebrsa ndaj I.H. \u00ebsht\u00eb caktuar paraburgim p\u00ebr shkak t\u00eb dyshimit t\u00eb bazuar se ka kryer vepr\u00ebn penale \u201cMosdh\u00ebnia e ndihm\u00ebs\u201d nga neni 188, paragrafi 4, lidhur me paragrafin 1 t\u00eb Kodit Penal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sipas Gjykat\u00ebs, nga provat e mbledhura deri n\u00eb k\u00ebt\u00eb faz\u00eb t\u00eb procedur\u00ebs, ekziston dyshimi i bazuar se m\u00eb 29 qershor 2026, rreth or\u00ebs 23:00, n\u00eb fshatin Zlipotok t\u00eb Komun\u00ebs s\u00eb Dragashit, i pandehuri B.H., me dashje, ka privuar nga jeta tani t\u00eb ndjerin G.T.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb njoftim thuhet se, &#8220;Sipas hetimeve t\u00eb deritanishme, ngjarja dyshohet t\u00eb ket\u00eb ndodhur si pasoj\u00eb e nj\u00eb mosmarr\u00ebveshjeje t\u00eb m\u00ebhershme nd\u00ebrmjet t\u00eb pandehurit dhe viktim\u00ebs lidhur me shfryt\u00ebzimin e nj\u00eb prone (livadhi)&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Po ashtu, Gjykata thekson se, &#8220;I pandehuri B.H., i ka shkaktuar viktim\u00ebs l\u00ebndime me mjet t\u00eb mpreht\u00eb (thik\u00eb), si pasoj\u00eb e t\u00eb cilave viktima G.T., ka nd\u00ebrruar jet\u00eb n\u00eb vendin e ngjarjes&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lidhur me t\u00eb pandehurin I.H., babain e t\u00eb dyshuarit B.H., n\u00eb njoftim thuhet se ai &#8220;dyshohet se, edhe pse ka qen\u00eb n\u00eb af\u00ebrsi t\u00eb vendit t\u00eb ngjarjes dhe ka pasur mund\u00ebsi t\u00eb ofroj\u00eb ndihm\u00eb pa rrezikuar veten apo t\u00eb tjer\u00ebt, nuk ka nd\u00ebrmarr\u00eb veprimet e nevojshme p\u00ebr t&#8217;i ofruar ndihm\u00eb viktim\u00ebs, e cila ndodhej n\u00eb rrezik t\u00eb drejtp\u00ebrdrejt\u00eb p\u00ebr jet\u00ebn&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gjykata ka theksuar se n\u00eb k\u00ebt\u00eb faz\u00eb t\u00eb procedur\u00ebs jan\u00eb plot\u00ebsuar kushtet ligjore p\u00ebr caktimin e paraburgimit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Kurse a do t\u00eb argumentohen k\u00ebto fakte do t\u00eb vler\u00ebsohet n\u00eb fazat e m\u00ebtejme t\u00eb procedur\u00ebs penale&#8221;, thuhet n\u00eb njoftim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sipas arsyetimit t\u00eb Gjykat\u00ebs, paraburgimi \u00ebsht\u00eb caktuar me q\u00ebllim t\u00eb sigurimit t\u00eb prezenc\u00ebs s\u00eb t\u00eb pandehurve dhe zhvillimit t\u00eb papenguar t\u00eb procedur\u00ebs penale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gjykata vler\u00ebson se, &#8220;me mas\u00ebn e paraburgimit do t\u00eb arrihet t\u00eb sigurohet prezenca e t\u00eb pandehurve dhe se do t\u00eb mund t\u00eb zhvillohen normalisht dhe pa pengesa procedura penale&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb arsyetim thuhet gjithashtu se pesha e vepr\u00ebs penale, m\u00ebnyra e kryerjes s\u00eb saj dhe rrethanat konkrete krijojn\u00eb rrezik t\u00eb ikjes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Duke pasur parasysh pesh\u00ebn e r\u00ebnd\u00eb t\u00eb veprave penale&nbsp;i dyshuari B.H., n\u00eb m\u00ebnyr\u00eb mizore apo dinake dyshohet t\u00eb ket\u00eb goditur me thik\u00eb n\u00eb shpin\u00eb dhe qaf\u00eb viktim\u00ebn ndjerin G.T., po ashtu duke shtuar faktin se i pandehuri \u00ebsht\u00eb larguar nga vendi i ngjarjes dhe \u00ebsht\u00eb gjetur dhe arrestuar nga Policia, p\u00ebr Gjykat\u00ebn rezulton se me l\u00ebnien n\u00eb liri ekziston rreziku i ikjes dhe arratisjes, me q\u00ebllim t\u00eb shmangies nga p\u00ebrgjegj\u00ebsia penale&#8221;, thuhet n\u00eb njoftim<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gjykata ka vler\u00ebsuar se masa e paraburgimit \u00ebsht\u00eb e domosdoshme p\u00ebr mbar\u00ebvajtjen e hetimeve, administrimin e provave materiale, marrjen n\u00eb pyetje t\u00eb d\u00ebshmitar\u00ebve dhe t\u00eb dyshuarve, si dhe p\u00ebr t\u00eb siguruar prezenc\u00ebn e tyre para organeve t\u00eb drejt\u00ebsis\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb fund, Gjykata thekson se &#8220;masa tjera alternative do t\u00eb ishin t\u00eb pamjaftueshme p\u00ebr sigurimin e prezenc\u00ebs s\u00eb t\u00eb dyshuarve dhe rrjedh\u00ebn e papenguar t\u00eb faz\u00ebs
