{"id":25409,"date":"2026-07-31T19:37:00","date_gmt":"2026-07-31T17:37:00","guid":{"rendered":"https:\/\/kosovatimes.info\/?p=25409"},"modified":"2026-07-31T20:26:55","modified_gmt":"2026-07-31T18:26:55","slug":"apeli-anulon-aktgjykimin-ndaj-lazoviqit-rasti-rikthehet-ne-rigjykim","status":"publish","type":"post","link":"https:\/\/kosovatimes.info\/index.php\/2026\/07\/31\/apeli-anulon-aktgjykimin-ndaj-lazoviqit-rasti-rikthehet-ne-rigjykim\/","title":{"rendered":"Apeli anulon aktgjykimin ndaj Lazoviqit, rasti rikthehet n\u00eb rigjykim"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><a target=\"_blank\" href=\"https:\/\/www.linkedin.com\/shareArticle?mini=true&amp;url=https%3A%2F%2Fwww.rtklive.com%2Fsq%2Fnews-single.php%3FID%3D730384\" rel=\"noreferrer noopener\"><\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><em>Gjykata e Apelit e Kosov\u00ebs, me aktvendimin APS.nr.19\/2026, ka aprovuar ankes\u00ebn e mbrojt\u00ebses s\u00eb t\u00eb akuzuarit Srdjan Lazovic, avokates Feride Xani, si dhe ankes\u00ebn e t\u00eb akuzuarit Srdjan Lazovic, dhe sipas detyr\u00ebs zyrtare ka anuluar aktgjykimin e Gjykat\u00ebs Themelore n\u00eb Prishtin\u00eb \u2013 Departamenti Special, PS.nr.93\/24 t\u00eb dat\u00ebs 03.02.2026, duke e kthyer \u00e7\u00ebshtjen penale n\u00eb rigjykim dhe vendim.<\/em><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Gjykata Themelore n\u00eb Prishtin\u00eb \u2013 Departamenti Special, me aktgjykimin PS.nr.93\/24 t\u00eb dat\u00ebs 03.02.2026, e kishte shpallur fajtor t\u00eb akuzuarin Srdjan Lazovic p\u00ebr vepr\u00ebn penale Krime lufte kund\u00ebr popullsis\u00eb civile n\u00eb bashk\u00ebkryerje, nga neni 142 lidhur me nenin 22 t\u00eb Ligjit Penal t\u00eb Republik\u00ebs Socialiste Federative t\u00eb Jugosllavis\u00eb dhe i kishte shqiptuar d\u00ebnim me burgim n\u00eb koh\u00ebzgjatje prej dymb\u00ebdhjet\u00eb (12) vite e gjasht\u00eb (6) muaj.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gjykata e Apelit, duke shqyrtuar aktgjykimin e ankimuar n\u00eb kuad\u00ebr t\u00eb pretendimeve ankimore dhe sipas detyr\u00ebs zyrtare, ka gjetur se aktgjykimi \u00ebsht\u00eb i p\u00ebrfshir\u00eb me shkelje esenciale t\u00eb dispozitave t\u00eb procedur\u00ebs penale nga neni 384 paragrafi 1 n\u00ebnparagrafi 1.10 dhe paragrafi 2 n\u00ebnparagrafi 2.7, lidhur me nenin 369 paragraf\u00ebt 6 dhe 7, si dhe se k\u00ebto shkelje kan\u00eb ndikuar edhe n\u00eb v\u00ebrtetimin e gabuar dhe jo t\u00eb plot\u00eb t\u00eb gjendjes faktike nga neni 386 paragraf\u00ebt 1 dhe 2 t\u00eb KPP-s\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gjykata e Apelit ka vler\u00ebsuar se gjykata e shkall\u00ebs s\u00eb par\u00eb, ndon\u00ebse gjat\u00eb shqyrtimit gjyq\u00ebsor kishte administruar nj\u00eb num\u00ebr t\u00eb konsideruesh\u00ebm provash materiale, nuk i ka trajtuar fare ato n\u00eb arsyetimin e aktgjykimit, nuk ka b\u00ebr\u00eb vler\u00ebsimin e tyre, nuk ka dh\u00ebn\u00eb arsye lidhur me vler\u00ebn e tyre provuese dhe nuk ka nxjerr\u00eb p\u00ebrfundime p\u00ebr r\u00ebnd\u00ebsin\u00eb e tyre n\u00eb v\u00ebrtetimin e gjendjes faktike.
