Ai pretendon se Gjykata ka p\u00ebrcaktuar se brenda k\u00ebtij afati Kuvendi duhet ta p\u00ebrfundoj\u00eb procesin e konstituimit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cGjykata, n\u00eb Aktgjykimin KO124\/25, e ka p\u00ebrcaktuar qart\u00eb se brenda 30 dit\u00ebve nga data e certifikimit t\u00eb rezultateve t\u00eb zgjedhjeve, Kuvendi duhet ta p\u00ebrfundoj\u00eb konstituimin, e jo vet\u00ebm ta filloj\u00eb at\u00eb, si\u00e7 po pretendon ti\u201d, \u00ebsht\u00eb shprehur Gruda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb mb\u00ebshtetje t\u00eb q\u00ebndrimit t\u00eb tij, deputeti i PDK-s\u00eb ka cituar paragrafin 140 t\u00eb aktgjykimit t\u00eb Kushtetueses, ku thuhet se afati i p\u00ebrcaktuar n\u00eb nenin 66 t\u00eb Kushtetut\u00ebs nuk duhet t\u00eb konsiderohet vet\u00ebm si afat p\u00ebr tentimin e konstituimit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cGjykata vler\u00ebson se afati 30 (tridhjet\u00eb) ditor i p\u00ebrcaktuar nga kushtetutb\u00ebr\u00ebsi n\u00eb paragrafin 1 t\u00eb nenit 66, nuk mund t\u00eb trajtohet si afat brenda t\u00eb cilit vet\u00ebm duhet provuar konstituimi i Kuvendit, porse ky afat (\u2026) \u00ebsht\u00eb afat brenda t\u00eb cilit duhet t\u00eb konstituohet Kuvendi\u201d, ka cituar Gruda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb fund t\u00eb reagimit, Gruda ka v\u00ebn\u00eb n\u00eb pik\u00ebpyetje nevoj\u00ebn q\u00eb \u00e7\u00ebshtja t\u00eb rikthehet p\u00ebr interpretim n\u00eb Gjykat\u00ebn Kushtetuese, duke argumentuar se ajo tashm\u00eb ka dh\u00ebn\u00eb q\u00ebndrimin e saj.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPra, kjo \u00e7\u00ebshtje \u00ebsht\u00eb interpretuar nj\u00eb her\u00eb nga Gjykata Kushtetuese dhe \u00ebsht\u00eb interpretuar qart\u00eb. \u00c7far\u00eb po k\u00ebrkon t\u00eb d\u00ebrgojm edhe nj\u00eb her\u00eb n\u00eb Gjykat\u00eb?
