ndryshimet e propozuara nga PDK-ja.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">P\u00ebrmes nj\u00eb shkrimi n\u00eb Facebook, Gruda ka th\u00ebn\u00eb se me projektligjin e propozuar nga PDK-ja \u00ebsht\u00eb p\u00ebrcaktuar shprehimisht kufiri i juridiksionit t\u00eb Dhom\u00ebs s\u00eb Specializuar Kushtetuese n\u00eb Hag\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sipas tij, Amendamenti nr. 24 i Kushtetut\u00ebs p\u00ebrcakton se Dhoma e Specializuar Kushtetuese, e p\u00ebrb\u00ebr\u00eb nga tre gjyqtar\u00eb nd\u00ebrkomb\u00ebtar\u00eb, vendos \u201cekskluzivisht mbi referimet kushtetuese sipas Nenit 113 t\u00eb Kushtetut\u00ebs n\u00eb lidhje me Dhomat e Specializuara dhe me Zyr\u00ebn e Prokurorit t\u00eb Specializuar n\u00eb p\u00ebrputhje me ligjin e ve\u00e7ant\u00eb\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gruda ka theksuar se pik\u00ebrisht mbi k\u00ebt\u00eb baz\u00eb, n\u00eb nenin 23 t\u00eb projektligjit t\u00eb propozuar \u00ebsht\u00eb p\u00ebrcaktuar se Dhoma Kushtetuese n\u00eb Hag\u00eb vendos vet\u00ebm p\u00ebr referimet kushtetuese q\u00eb burojn\u00eb nga vendimet, urdhrat ose aktgjykimet e Dhomave t\u00eb Specializuara dhe t\u00eb Zyr\u00ebs s\u00eb Prokurorit t\u00eb Specializuar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNeni 23 p\u00ebrcakton se ajo vendos vet\u00ebm p\u00ebr referimet kushtetuese q\u00eb burojn\u00eb nga vendimet, urdhrat ose aktgjykimet e Dhomave t\u00eb Specializuara dhe t\u00eb Zyr\u00ebs s\u00eb Prokurorit t\u00eb Specializuar\u201d, ka shkruar&nbsp;Gruda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ai ka th\u00ebn\u00eb se projektligji e p\u00ebrjashton shprehimisht kontrollin abstrakt, paraprak, konkret dhe incidental t\u00eb kushtetutshm\u00ebris\u00eb s\u00eb ligjeve nga juridiksioni i k\u00ebsaj Dhome.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNuk ka juridiksion p\u00ebr kontrollin abstrakt (paraprak), konkret dhe incidental t\u00eb kushtetutshm\u00ebris\u00eb s\u00eb ligjeve ose Ligjit Nr. 05\/L-053\u201d, ka&nbsp;th\u00ebn\u00eb Gruda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sipas tij, projektligji p\u00ebrcakton gjithashtu se kontrolli i kushtetutshm\u00ebris\u00eb s\u00eb Ligjit p\u00ebr Dhomat e Specializuara dhe Zyr\u00ebn e Prokurorit t\u00eb Specializuar, si dhe i ligjeve q\u00eb e ndryshojn\u00eb, plot\u00ebsojn\u00eb ose shfuqizojn\u00eb at\u00eb, do t\u00eb b\u00ebhet nga Gjykata Kushtetuese e Republik\u00ebs s\u00eb Kosov\u00ebs n\u00eb Prishtin\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cKontrolli i kushtetutshm\u00ebris\u00eb s\u00eb k\u00ebtij ligji, si dhe i ligjeve me t\u00eb cilat ndryshohet, plot\u00ebsohet ose shfuqizohet Ligji Nr. 05\/L-053, ushtrohet nga Gjykata Kushtetuese e Republik\u00ebs s\u00eb Kosov\u00ebs n\u00eb p\u00ebrb\u00ebrjen e saj t\u00eb rregullt n\u00eb Prishtin\u00eb, n\u00eb pajtim me nenin 113 t\u00eb Kushtetut\u00ebs\u201d, ka shkruar ai.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gruda ka kund\u00ebrshtuar k\u00ebshtu interpretimet se, pas miratimit t\u00eb ndryshimeve, ligji mund t\u00eb d\u00ebrgohet n\u00eb Dhom\u00ebn e Specializuar Kushtetuese n\u00eb Hag\u00eb dhe t\u00eb shfuqizohet prej saj.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPrandaj, sipas ndryshimeve t\u00eb propozuara, Dhoma Kushtetuese n\u00eb Hag\u00eb nuk do t\u00eb ket\u00eb juridiksion p\u00ebr ta kontrolluar apo shfuqizuar k\u00ebt\u00eb ligj\u201d, ka th\u00ebn\u00eb Gruda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ai ka shtuar se Dhoma e Specializuar Kushtetuese n\u00eb Hag\u00eb nuk p\u00ebrb\u00ebn nj\u00eb gjykat\u00eb kushtetuese t\u00eb ndar\u00eb nga Gjykata Kushtetuese e Kosov\u00ebs, por \u00ebsht\u00eb nj\u00eb dhom\u00eb e specializuar me juridiksion t\u00eb posa\u00e7\u00ebm.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAjo nuk \u00ebsht\u00eb nj\u00eb Gjykat\u00eb Kushtetuese e ve\u00e7ant\u00eb nga Gjykata Kushtetuese e Kosov\u00ebs, por nj\u00eb Dhom\u00eb e Specializuar me juridiksion t\u00eb posa\u00e7\u00ebm\u201d, ka deklaruar deputeti i PDK-s\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sipas tij, n\u00eb rast t\u00eb miratimit t\u00eb ndryshimeve t\u00eb propozuara, kompetenca p\u00ebr kontrollin kushtetues t\u00eb akteve t\u00eb Kuvendit, p\u00ebrfshir\u00eb ndryshimet n\u00eb Ligjin p\u00ebr Dhomat e Specializuara dhe Zyr\u00ebn e Prokurorit t\u00eb Specializuar, do t\u2019i mbetet Gjykat\u00ebs Kushtetuese t\u00eb
