Po flas k\u00ebtu n\u00eb cil\u00ebsin\u00eb e profesorit t\u00eb s\u00eb drejt\u00ebs kushtetuese, nj\u00ebri prej hartuesve t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, dhe fillimisht dua t\u00eb theksoj se Kushtetuta e Republik\u00ebs s\u00eb Kosov\u00ebs ka promovuar standardet m\u00eb t\u00eb larta p\u00ebr Lirit\u00eb dhe t\u00eb Drejtat e Njeriut. Pra, kapitulli 2 dhe 3 i Kushtetut\u00ebs s\u00eb Kosov\u00ebs do t\u00eb trajtoj\u00eb nj\u00eb nga modelet m\u00eb t\u00eb mira evropiane se si zbatohet Konventa Evropiane p\u00ebr t\u00eb Drejtat e Njeriut. Dhe n\u00ebse Republika e Kosov\u00ebs ka promovuar k\u00ebto standarde kaq t\u00eb larta, ka t\u00eb drejt\u00eb legitime q\u00eb t\u00eb k\u00ebrkoj\u00eb respektimin e tyre ndaj shtetasve t\u00eb Kosov\u00ebs&#8221;, tha Bajrami.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ai tha se themelimi i Dhomave t\u00eb Specializuara ishte nj\u00eb moment delikat p\u00ebr Kosov\u00ebn dhe se vendimi p\u00ebr delegimin e sovranitetit ishte marr\u00eb me besimin se gjykata do t\u00eb promovonte standardet m\u00eb t\u00eb larta t\u00eb drejt\u00ebsis\u00eb evropiane.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;N\u00eb radh\u00eb t\u00eb par\u00eb dua t&#8217;i adresohem k\u00ebtu mysafir\u00ebve nd\u00ebrkomb\u00ebtar\u00eb, p\u00ebrfaq\u00ebsuesve t\u00eb K\u00ebshillit t\u00eb Evrop\u00ebs, p\u00ebrfaq\u00ebsuesve t\u00eb zyrave diplomatike, p\u00ebr t\u00eb treguar se themelimi i Dhomave t\u00eb Specializuara ka qen\u00eb nj\u00eb moment shum\u00eb delikat p\u00ebr Republik\u00ebn e Kosov\u00ebs, sepse ka filluar pas konfirmimit t\u00eb Gjykat\u00ebs Nd\u00ebrkomb\u00ebtare t\u00eb Drejt\u00ebsis\u00eb dhe opinionit k\u00ebshilldh\u00ebn\u00ebs me t\u00eb cil\u00ebn \u00ebsht\u00eb konfirmuar se procesi i shpalljes s\u00eb pavar\u00ebsis\u00eb s\u00eb Kosov\u00ebs ka qen\u00eb n\u00eb pajtim t\u00eb plot\u00eb me t\u00eb drejt\u00ebn nd\u00ebrkomb\u00ebtare. Dhe ky proces \u00ebsht\u00eb zhvilluar me mir\u00ebbesim. Pra, Republika e Kosov\u00ebs ka marr\u00eb nj\u00eb vendim shum\u00eb t\u00eb r\u00ebnd\u00eb q\u00eb n\u00eb em\u00ebr t\u00eb sovranitetit sovran t\u00eb delegoj\u00eb sovranitetin e vet te nj\u00eb gjykat\u00eb e specializuar me besimin e popullit t\u00eb Kosov\u00ebs q\u00eb ajo do t\u00eb promovoj\u00eb standardet m\u00eb t\u00eb larta t\u00eb drejt\u00ebsis\u00eb evropiane. P\u00ebr shkak se edhe vet\u00eb K\u00ebshilli i Evrop\u00ebs, por edhe vet\u00eb Bashkimi Evropian \u00ebsht\u00eb i nd\u00ebrtuar mbi bazat e sundimit t\u00eb ligjit&#8221;, theksoi ai.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bajrami tha se, pas dhjet\u00eb vjet\u00ebsh, n\u00eb vend t\u00eb nj\u00eb procesi model, qytetar\u00ebt dhe institucionet e Kosov\u00ebs po shprehin shqet\u00ebsime p\u00ebr respektimin e lirive dhe t\u00eb drejtave t\u00eb njeriut.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Dhe, n\u00eb vend q\u00eb ne t\u00eb shohim k\u00ebt\u00eb vit tani po b\u00ebhen 10 vite nj\u00eb proces model t\u00eb promovimit t\u00eb standardeve t\u00eb larta t\u00eb Bashkimit Evropian, me t\u00eb drejt\u00eb populli i Kosov\u00ebs, qytetar\u00ebt e Kosov\u00ebs, institucionet e Republik\u00ebs s\u00eb Kosov\u00ebs, Kuvendi i Kosov\u00ebs, Avokati i Popullit po shprehin shqet\u00ebsimin legjitim p\u00ebr respektimin e lirive dhe t\u00eb drejtave t\u00eb njeriut n\u00eb nj\u00eb proces i cili \u00ebsht\u00eb premtuar se do t\u00eb jet\u00eb proces i drejt\u00eb, nj\u00eb proces q\u00eb do t\u00eb arsyetonte komplet pritjet e qytetar\u00ebve evropian\u00eb e taksapaguesve evropian\u00eb dhe q\u00eb do t\u00eb promovonte standardet m\u00eb t\u00eb larta&#8221;, tha Bajrami.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ai kritikoi procesin gjyq\u00ebsor n\u00eb Dhomat e Specializuara, duke pretenduar se jan\u00eb evidentuar shkelje materiale dhe procedurale, si dhe mosrespektim i standardeve nd\u00ebrkomb\u00ebtare p\u00ebr gjykim t\u00eb drejt\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;N\u00eb vend t\u00eb k\u00ebsaj, k\u00ebt\u00eb vit kemi qen\u00eb d\u00ebshmitar\u00eb t\u00eb nj\u00eb procesi t\u00eb mbyllur, me p\u00ebrplot shkelje, shkelje materiale, shkelje procedurale, jo vet\u00ebm t\u00eb legjislacionit t\u00eb nj\u00eb shteti sovran si\u00e7 \u00ebsht\u00eb Republika e Kosov\u00ebs, por edhe t\u00eb standardeve t\u00eb Bashkimit Evropian, n\u00eb radh\u00eb t\u00eb par\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut, standardeve nd\u00ebrkomb\u00ebtare p\u00ebr gjykim t\u00eb drejt\u00eb. Dhe ato shkelje jan\u00eb notore, evidente, jan\u00eb shkelje materiale, jan\u00eb shkelje procedurale, t\u00eb cilat \u00e7do jurist i pavarur, \u00e7do jurist pa ndikime politike e ka leht\u00ebsisht p\u00ebr t&#8217;i v\u00ebrejtur&#8221;, tha ai.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bajrami tha se procesi, sipas vler\u00ebsimit t\u00eb tij, ka shkelur parimet baz\u00eb t\u00eb drejt\u00ebsis\u00eb penale, p\u00ebrfshir\u00eb prezumimin e pafaj\u00ebsis\u00eb, barazin\u00eb e pal\u00ebve dhe transparenc\u00ebn. Ai ngriti gjithashtu pretendime p\u00ebr bashk\u00ebpunimin me Prokurorin\u00eb Speciale t\u00eb Serbis\u00eb dhe p\u00ebr munges\u00ebn e bashk\u00ebpunimit me institucionet e Kosov\u00ebs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Pra, n\u00eb vend q\u00eb Bashkimi Evropian sot t\u00eb mburret q\u00eb ka zhvilluar nj\u00eb proces model q\u00eb ndoshta i ka tejkaluar edhe standardet e Tribunaleve Penale p\u00ebr ish-Jugosllavin\u00eb, ai sot ka nj\u00eb hipotek\u00eb t\u00eb nj\u00eb procesi me shum\u00eb t\u00eb meta, nj\u00eb procesi q\u00eb ka qen\u00eb hermetikisht i mbyllur, i cili t\u00ebr\u00ebsisht ka shkelur parimet baz\u00eb t\u00eb drejt\u00ebsis\u00eb penale: pra parimin e prezumimit t\u00eb pafaj\u00ebsis\u00eb, parimin e barazis\u00eb s\u00eb pal\u00ebve, parimin e transparenc\u00ebs, parimin e ekonomizimit, parimin e gjykimit t\u00eb drejt\u00eb dhe dhjet\u00ebra parime q\u00eb specialist\u00ebt e s\u00eb drejt\u00ebs penale i kan\u00eb leht\u00ebsisht t\u00eb kuptueshme. Dhe, n\u00eb fakt, kan\u00eb zhvilluar nj\u00eb proces t\u00eb paparabar\u00eb, ku n\u00eb vend t\u00eb mir\u00ebbesimit, dhe q\u00eb t&#8217;i kthejn\u00eb Kosov\u00ebs me mir\u00ebbesim k\u00ebt\u00eb vendim t\u00eb r\u00ebnd\u00eb, kan\u00eb zhvilluar nj\u00eb hetim t\u00eb t\u00ebr\u00eb koh\u00ebs me nj\u00eb shtet q\u00eb ka ushtruar dhun\u00eb, represion n\u00eb nivel t\u00eb genocidit, dhe publikisht kan\u00eb treguar se kan\u00eb bashk\u00ebpunuar gjith\u00eb koh\u00ebn me prokurorin\u00eb speciale t\u00eb Serbis\u00eb, madje edhe kan\u00eb ndar\u00eb shp\u00ebrblime p\u00ebr prokuror\u00ebt special\u00eb serb\u00eb p\u00ebr dosjet e fabrikuara, dosjet fallso me t\u00eb cilat Serbia e ka ushqyer, p\u00ebrderisa nuk kan\u00eb pranuar asnj\u00eb korrespondenc\u00eb me shtetin am\u00eb, me shtetin e Kosov\u00ebs, pra me Republik\u00ebn e Kosov\u00ebs, p\u00ebr m\u00eb tep\u00ebr nuk kan\u00eb pranuar as bashk\u00ebpunimin me Avokatin e Popullit, q\u00eb \u00ebsht\u00eb nj\u00eb institucion i pavarur q\u00eb ka t\u00eb drejt\u00eb legitime t\u00eb kujdeset p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb shtetasve t\u00eb Kosov\u00ebs&#8221;, ka th\u00ebn\u00eb ai.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb fund, Bajrami tha se procesi ka shqet\u00ebsuar qytetar\u00ebt e Kosov\u00ebs, t\u00eb cil\u00ebt, sipas tij, kan\u00eb pritur nj\u00eb gjykim t\u00eb drejt\u00eb. Ai vuri n\u00eb pik\u00ebpyetje legjitimitetin e akuzimit n\u00eb em\u00ebr t\u00eb popullit t\u00eb Kosov\u00ebs, duke iu referuar edhe q\u00ebndrimeve t\u00eb qytetar\u00ebve dhe Kuvendit t\u00eb Kosov\u00ebs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;I t\u00ebr\u00eb ky proces, n\u00eb fakt, ka shqet\u00ebsuar qytetar\u00ebt e Kosov\u00ebs an\u00eb e mban\u00eb. T\u00eb cil\u00ebt kan\u00eb pritur nj\u00eb gjykim t\u00eb drejt\u00eb. Dhe sot ata an\u00eb e mban\u00eb Kosov\u00ebs po shprehin se ky akuzim nuk ka legjitimitet t\u00eb mbaj\u00eb thirrjen n\u00eb em\u00ebr t\u00eb popullit t\u00eb Kosov\u00ebs. Jo! Nuk \u00ebsht\u00eb akuzim n\u00eb em\u00ebr t\u00eb popullit t\u00eb Kosov\u00ebs.
