\u00ebsht\u00eb publikuar n\u00eb t\u00eb nj\u00ebjt\u00ebn dit\u00eb kur ato kan\u00eb pranuar p\u00ebrgjigjen e tij zyrtare, drejtuar kryetares s\u00eb Dhomave t\u00eb Specializuara, Ekaterina Trendafilova, n\u00eb t\u00eb cil\u00ebn jan\u00eb paraqitur argumentet juridike lidhur me mandatin dhe kompetencat e institucionit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Avokati i Popullit ka theksuar se institucioni i tij \u00ebsht\u00eb themeluar me Kushtetut\u00eb dhe ka mandat t\u00eb p\u00ebrgjithsh\u00ebm p\u00ebr mbrojtjen dhe promovimin e t\u00eb drejtave dhe lirive themelore t\u00eb njeriut.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb k\u00ebt\u00eb drejtim, ai ka vler\u00ebsuar se p\u00ebrgjegj\u00ebsia ekskluzive q\u00eb i \u00ebsht\u00eb caktuar Zyr\u00ebs s\u00eb Avokatit t\u00eb Popullit n\u00eb Hag\u00eb nuk n\u00ebnkupton p\u00ebrjashtimin e kompetencave t\u00eb institucionit t\u00eb tij p\u00ebr t&#8217;u angazhuar n\u00eb \u00e7\u00ebshtjet q\u00eb lidhen me Dhomat e Specializuara.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSipas vler\u00ebsimit tim, nj\u00eb interpretim i till\u00eb do t\u00eb ngat\u00ebrronte dy koncepte t\u00eb dallueshme juridike: \u2018p\u00ebrgjegj\u00ebsin\u00eb ekskluzive\u2019 dhe \u2018kompetenc\u00ebn ekskluzive\u2019\u201d, thuhet n\u00eb reagimin e Avokatit t\u00eb Popullit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ai ka sqaruar se p\u00ebrgjegj\u00ebsia ekskluzive p\u00ebrb\u00ebn detyrim t\u00eb posa\u00e7\u00ebm institucional p\u00ebr t\u00eb vepruar, por jo t\u00eb drejt\u00eb p\u00ebr t\u00eb penguar veprimtarin\u00eb e institucioneve t\u00eb tjera.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cP\u00ebrgjegj\u00ebsia ekskluzive dhe kompetenca ekskluzive p\u00ebrb\u00ebjn\u00eb dy koncepte juridike t\u00eb dallueshme, t\u00eb cilat nuk mund t\u00eb p\u00ebrdoren si sinonime\u201d, ka theksuar Avokati i Popullit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Qelaj ka ngritur gjithashtu shqet\u00ebsime lidhur me ushtrimin e funksionit monitorues nga Zyra e Avokatit t\u00eb Popullit n\u00eb Hag\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSi\u00e7 e kuptoj un\u00eb \u00e7\u00ebshtjen, deri m\u00eb tani, Zyra e Avokatit t\u00eb Popullit n\u00eb Hag\u00eb nuk e ka ushtruar n\u00eb praktik\u00eb funksionin e saj monitorues p\u00ebr t\u2019iu p\u00ebrgjigjur shqet\u00ebsimeve lidhur me t\u00eb drejtat e njeriut t\u00eb personave q\u00eb jan\u00eb subjekt i procedurave gjyq\u00ebsore para Dhomave t\u00eb Specializuara\u201d, ka deklaruar ai.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sipas Avokatit t\u00eb Popullit, kjo rrethan\u00eb ngre pyetje lidhur me p\u00ebrmbushjen n\u00eb praktik\u00eb t\u00eb p\u00ebrgjegj\u00ebsis\u00eb q\u00eb i \u00ebsht\u00eb caktuar k\u00ebtij mekanizmi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ai ka sqaruar se q\u00ebndrimi i tij nuk n\u00ebnkupton se mandati i Institucionit t\u00eb Avokatit t\u00eb Popullit t\u00eb Kosov\u00ebs mbizot\u00ebron ose z\u00ebvend\u00ebson p\u00ebrgjegj\u00ebsit\u00eb e Zyr\u00ebs s\u00eb Avokatit t\u00eb Popullit n\u00eb Hag\u00eb, por se k\u00ebto institucione kan\u00eb mandate plot\u00ebsuese.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Avokati i Popullit ka rikujtuar se q\u00eb nga viti 2021 ka ngritur vazhdimisht shqet\u00ebsime pran\u00eb Dhomave t\u00eb Specializuara, p\u00ebrfshir\u00eb p\u00ebrmes korrespondenc\u00ebs zyrtare, ndaj s\u00eb cil\u00ebs, sipas tij, nuk \u00ebsht\u00eb dh\u00ebn\u00eb asnj\u00eb p\u00ebrgjigje.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMungesa e vazhdueshme e p\u00ebrgjigjes ngre shqet\u00ebsime serioze lidhur me transparenc\u00ebn dhe krijon perceptimin se informacioni mund t\u00eb mbahet q\u00ebllimisht i fsheht\u00eb\u201d, thuhet n\u00eb reagim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ai ka theksuar se ngritja e shqet\u00ebsimeve dhe dh\u00ebnia e rekomandimeve jan\u00eb n\u00eb p\u00ebrputhje me mandatin e tij ligjor dhe nuk duhet t\u00eb interpretohen si nd\u00ebrhyrje n\u00eb pavar\u00ebsin\u00eb gjyq\u00ebsore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPavar\u00ebsia gjyq\u00ebsore nuk mund t\u00eb sh\u00ebrbej\u00eb si arsyetim p\u00ebr munges\u00ebn e transparenc\u00ebs ose t\u00eb llogaridh\u00ebnies institucionale\u201d, ka theksuar Avokati i Popullit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb fund t\u00eb reagimit, Qelaj ka kritikuar q\u00ebndrimin e Dhomave t\u00eb Specializuara, duke vler\u00ebsuar se reagimet publike q\u00eb vendosin kufizime ndaj mandatit t\u00eb nj\u00eb autoriteti kushtetues cenojn\u00eb rolin e tij.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cK\u00ebt\u00eb reagim e shohim me shum\u00eb interes, sepse reagimet publike duke vendos kritika e kufizime t\u00eb mandatit t\u00eb nj\u00eb autoriteti kushtetues si\u00e7 \u00ebsht\u00eb Avokati i Popullit dhe duke u sjell me q\u00ebndrime arbitrare dhe ta pa arsyetuara, p\u00ebrben veprim q\u00eb cenon rolin dhe pesh\u00ebn e nj\u00eb Institucioni t\u00eb
