konkursi t\u00eb ri pa baz\u00eb ligjore p\u00ebrb\u00ebn \u201cnj\u00eb nga shembujt m\u00eb t\u00eb qart\u00eb t\u00eb mosrespektimit t\u00eb ligjit, zvarritjes institucionale dhe vendimmarrjes arbitrare\u201d.<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">IKD thekson se Kryesia e Kuvendit, pas p\u00ebrfundimit t\u00eb t\u00eb gjitha procedurave ligjore dhe propozimit t\u00eb dy kandidat\u00ebve p\u00ebr votim, \u201cn\u00eb m\u00ebnyr\u00eb arbitrare ka vendosur q\u00eb t\u00eb mos votoj asnj\u00ebrin prej tyre dhe t\u00eb shpall\u00eb konkurs t\u00eb ri\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sipas IKD-s\u00eb, kjo m\u00ebnyr\u00eb e veprimit \u00ebsht\u00eb \u201cn\u00eb kund\u00ebrshtim t\u00eb hapur me legjislacionin n\u00eb fuqi\u201d, cenon sigurin\u00eb juridike t\u00eb kandidat\u00ebve dhe rrezikon krijimin e \u201cnj\u00eb standardi t\u00eb rreziksh\u00ebm institucional\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instituti rikujton se procesi p\u00ebr p\u00ebrzgjedhjen e Sekretarit t\u00eb P\u00ebrgjithsh\u00ebm ka nisur m\u00eb 31 gusht 2024, me shpalljen e konkursit publik, nd\u00ebrsa pas p\u00ebrfundimit t\u00eb t\u00eb gjitha fazave t\u00eb parapara ligjore, m\u00eb 30 dhjetor 2024 raporti p\u00ebrfundimtar i \u00ebsht\u00eb dor\u00ebzuar Kryesis\u00eb s\u00eb Kuvendit p\u00ebr vendimmarrje.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb k\u00ebt\u00eb proces, dy kandidat\u00ebt q\u00eb kan\u00eb kaluar pragun ligjor dhe jan\u00eb propozuar p\u00ebr p\u00ebrzgjedhje kan\u00eb qen\u00eb Arben Loshi me 90.2 pik\u00eb dhe Taulant Bajrami me 88.2 pik\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNuk ka pasur asnj\u00eb ankes\u00eb, asnj\u00eb kontestim procedural dhe asnj\u00eb v\u00ebrejtje p\u00ebr ligjshm\u00ebrin\u00eb e procesit\u201d, thuhet n\u00eb reagim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">IKD thekson se sipas nenit 19 t\u00eb Rregullores s\u00eb Kuvendit, si dhe neneve 47 dhe 49 t\u00eb Ligjit p\u00ebr Zyrtar\u00ebt Publik, Kryesia e Kuvendit ka qen\u00eb e obliguar q\u00eb brenda 30 dit\u00ebve nga shpallja e kandidat\u00ebve fitues t\u00eb p\u00ebrzgjedh\u00eb dhe em\u00ebroj\u00eb nj\u00ebrin nga kandidat\u00ebt e propozuar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cKy afat ka skaduar prej koh\u00ebsh dhe Kryesia nuk ka nd\u00ebrmarr\u00eb asnj\u00eb veprim p\u00ebr ta zbatuar ligjin\u201d, thuhet m\u00eb tej.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sipas IKD-s\u00eb, edhe opinioni juridik i p\u00ebrgatitur p\u00ebr Kryesin\u00eb e Kuvendit konstaton se Drejtoria p\u00ebr Menaxhimin e Burimeve Njer\u00ebzore i ka nd\u00ebrmarr\u00eb t\u00eb gjitha hapat e nevojsh\u00ebm ligjor\u00eb dhe se n\u00eb asnj\u00eb pjes\u00eb t\u00eb tij nuk konstatohet se procesi ka pasur shkelje, mang\u00ebsi ose arsye ligjore p\u00ebr anulim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cKryesia nuk ka pasur p\u00ebrpara nj\u00eb proces t\u00eb d\u00ebshtuar, por nj\u00eb proces t\u00eb p\u00ebrfunduar, t\u00eb ligjsh\u00ebm dhe t\u00eb pakontestuar, ku ka qen\u00eb e obliguar t\u00eb zgjedh\u00eb nj\u00ebrin nga dy kandidat\u00ebt e propozuar\u201d, vler\u00ebson IKD.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instituti shton se moszgjedhja e kandidatit \u201cnuk \u00ebsht\u00eb thjesht nj\u00eb l\u00ebshim procedural\u201d, por \u201cp\u00ebrb\u00ebn refuzim p\u00ebr t\u00eb zbatuar ligjin sipas rezultatit t\u00eb nj\u00eb procesi t\u00eb ligjsh\u00ebm administrativ\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">M\u00eb tej, IKD e cil\u00ebson shqet\u00ebsues faktin q\u00eb propozimi p\u00ebr anulimin e konkursit nuk ka marr\u00eb mb\u00ebshtetjen e nevojshme n\u00eb Kryesi, pasi me tre vota p\u00ebr dhe tre abstenime nuk \u00ebsht\u00eb marr\u00eb asnj\u00eb vendim p\u00ebrfundimtar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cKjo situat\u00eb krijon nj\u00eb precedent t\u00eb rreziksh\u00ebm p\u00ebr t\u00eb gjitha institucionet publike\u201d, thuhet n\u00eb reagim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">IKD konsideron se p\u00ebrgjegj\u00ebsia p\u00ebr k\u00ebt\u00eb situat\u00eb bie fillimisht mbi Kryetaren e Kuvendit t\u00eb Kosov\u00ebs dhe, n\u00eb an\u00ebn tjet\u00ebr, mbi t\u00eb gjith\u00eb an\u00ebtar\u00ebt e Kryesis\u00eb, p\u00ebrfshir\u00eb edhe p\u00ebrfaq\u00ebsuesit e opozit\u00ebs, t\u00eb cil\u00ebt sipas procesverbalit t\u00eb mbledhjes s\u00eb 2 marsit 2026 \u201cnuk kan\u00eb reaguar ndaj shkeljeve t\u00eb qarta ligjore\u201d dhe \u201ckan\u00eb abstenuar kur \u00ebsht\u00eb propozuar anulimi i konkursit\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Po ashtu, IKD rikujton se sipas Ligjit Nr.08\/L-294 p\u00ebr Plot\u00ebsimin dhe Ndryshimin e Ligjit Nr.08\/L-197 p\u00ebr Zyrtar\u00ebt Publik, nj\u00eb pozit\u00eb mund t\u00eb mbahet me ushtrues detyre maksimum deri n\u00eb dy vjet, nd\u00ebrsa sipas standardit t\u00eb vendosur nga Gjykata Supreme kjo periudh\u00eb i referohet pozit\u00ebs dhe jo personit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAndaj, sipas ligjit, pas periudh\u00ebs (2) vje\u00e7are, nj\u00eb pozit\u00eb nuk mund t\u00eb mbahet fare me UD\u201d, thekson IKD.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb fund, IKD i b\u00ebn thirrje Kuvendit t\u00eb Kosov\u00ebs \u201cq\u00eb t\u00eb rikthej\u00eb ligjshm\u00ebrin\u00eb n\u00eb k\u00ebt\u00eb proces, duke p\u00ebrzgjedhur menj\u00ebher\u00eb nj\u00ebrin nga kandidat\u00ebt e propozuar dhe duke ndalur praktikat arbitrare q\u00eb cenojn\u00eb integritetin e administrat\u00ebs publike,
